Legal Protection of the Land Rights of the Mukomuko Community in Land Use Conversion for the National Strategic Project (PSN) Food Estate

Main Article Content

Abstract

Land use conversion for Indonesia’s Food Estate National Strategic Project (PSN) raises concerns about potential agrarian conflict and the protection of community land rights. This study examined the legal protection afforded to the Mukomuko community, the conformity of land conversion policy with applicable agrarian legislation, and the legal remedies available to affected rights holders. A normative juridical method was employed, combining statutory and conceptual approaches through an examination of regulations concerning agrarian affairs, human rights, land acquisition for public purposes, and National Strategic Projects. The analysis identifies essential safeguards for community land rights: legal certainty regarding land status and boundaries, recognition of lawful ownership and tenure rights, transparency in land conversion procedures, meaningful community participation, and fair compensation where land acquisition is undertaken pursuant to applicable law. It further emphasizes that dispute resolution must provide community members with access to objection mechanisms and available legal remedies. The study concludes that implementing the Food Estate programme requires balancing national food security objectives with the protection of community land rights. It clarifies the legal safeguards that should guide land conversion and dispute resolution, emphasizing justice, legal certainty, and respect for community rights as integral requirements of development.
